Terms of Service

These Terms of Service ("Terms") govern your use of the SyzUp mobile application ("the app", "SyzUp", "we", "us", "our"). By downloading, installing, or using SyzUp, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the app.

1. Eligibility

You must be at least 16 years old (or the applicable age of digital consent in your jurisdiction) to use SyzUp. If you are between 16 and 18, you confirm that your parent or legal guardian has reviewed and consents to these Terms.

2. Health & Fitness Disclaimer

2.1 Not Medical or Professional Advice

All content provided by SyzUp — including but not limited to workout plans, exercise suggestions, AI-generated training programs, rest time recommendations, muscle recovery estimates, calorie and TDEE calculations, one-rep max estimates, progression suggestions, and any other fitness-related information — is for informational and personal tracking purposes only. None of this content constitutes:

• Medical advice or diagnosis
• Physiotherapy or rehabilitation guidance
• Nutritional or dietary counseling
• Certified personal training services
• Professional coaching of any kind

2.2 Mandatory Consultation

Before beginning any exercise program, changing your workout routine, or following any training plan (including AI-generated plans) from SyzUp, you must:

• Consult with a qualified physician or healthcare provider — especially if you have any pre-existing medical conditions, cardiovascular issues, joint problems, injuries, chronic conditions, are pregnant, are recovering from surgery, or have any health concerns whatsoever.
• Consult with a certified personal trainer or qualified fitness professional if you are unfamiliar with proper exercise form and technique.
• Immediately stop exercising and seek medical attention if you experience pain, dizziness, nausea, shortness of breath, chest tightness, or any other concerning symptoms during or after exercise.

2.3 AI-Generated Content Disclaimer

SyzUp uses artificial intelligence (via OpenAI) to generate workout plans. These plans are generated algorithmically and:

• May not account for your individual health conditions, physical limitations, injuries, mobility restrictions, or actual fitness level.
• May contain errors, inappropriate exercises, or unsuitable programming.
• Should be reviewed critically and modified by you (or a qualified professional) to suit your personal needs.
• Are not a replacement for professional program design.

We make no guarantees regarding the safety, suitability, accuracy, completeness, or effectiveness of AI-generated workout plans or any other algorithmically generated content.

2.4 Assumption of Risk

Physical exercise carries inherent and significant risks including, but not limited to: muscle strains, ligament and tendon injuries, joint damage, spinal injuries, bone fractures, cardiovascular events (including heart attack and stroke), rhabdomyolysis, dehydration, and in extreme cases, death. These risks exist regardless of your fitness level or experience.

By using SyzUp, you acknowledge that you understand these risks and voluntarily assume full responsibility for any and all risks of injury, illness, disability, or death that may result from your participation in any physical activities tracked, suggested, recommended, or generated by the app.

2.5 No Guarantee of Results

SyzUp does not guarantee any specific fitness results, weight loss, muscle gain, strength improvements, aesthetic changes, or health outcomes. Individual results vary enormously based on factors outside our control, including genetics, diet, sleep, stress, consistency, pre-existing conditions, age, and many other variables.

2.6 Calculations and Estimates

All numerical calculations in SyzUp (including but not limited to TDEE, BMR, one-rep max, volume load, caloric expenditure, and muscle recovery time) are mathematical estimates only. They are based on general population formulas and may not accurately reflect your individual physiology. Do not make health decisions based solely on these estimates.

2.7 Trainers

Trainers who use the SyzUp trainer panel are independent users, not employees or agents of SyzUp. SyzUp does not verify their qualifications and is not responsible for their advice, programmes or services. Any arrangement between you and a trainer, including payment for their services, is between you and the trainer.

3. Your Account

• You are responsible for maintaining the security of your account credentials.
• You must provide accurate information during registration.
• You must not create accounts for other people without their permission.
• You must not share, sell, or transfer your account.
• You are responsible for all activity under your account.
• Notify us immediately if you suspect unauthorized access.

4. Acceptable Use

You agree not to:

• Use SyzUp for any unlawful purpose or in violation of any applicable law.
• Post offensive, abusive, harassing, threatening, hateful, defamatory, or discriminatory content.
• Post sexually explicit, violent, or otherwise objectionable content.
• Impersonate any person or entity.
• Upload viruses, malware, or harmful code.
• Attempt to access other users' data or accounts.
• Reverse-engineer, decompile, or disassemble the app.
• Use automated tools, bots, or scripts to interact with the app.
• Manipulate the gamification system through fraudulent activity.
• Abuse the AI workout generation feature.
• Circumvent security measures, rate limits, or access controls.
• Scrape, harvest, or collect data from other users.
• Use the app to spam, phish, or conduct any fraudulent scheme.

5. User-Generated Content & Licenses

5.1 Your Content

You may post content through SyzUp (feed posts, comments, Arena record videos, profile photos and, where the feature is enabled, private messages). You retain ownership of your content.

5.2 License to SyzUp

By posting or uploading content to SyzUp, you grant us a worldwide, non-exclusive, royalty-free, sublicensable, transferable license to use, reproduce, modify, adapt, process, and display your content for the following purposes:

• Displaying your content within the app's social features (feed, profiles, rankings)
• Operating, maintaining, and improving SyzUp
• Developing new features and services

We do not use your content to train machine learning or AI models.

5.3 What We Will NOT Do

• We will never sell your identifiable content to third parties.
• We will never use your identifiable photos or videos in marketing without your separate, explicit consent.
• We will never share your identifiable content outside of SyzUp's social features without your permission.

5.4 Content Removal

We may remove content that violates these Terms, applicable laws, or community standards. We are not responsible for content posted by other users. You can report inappropriate content through the app. Where required by applicable law, we will inform you of the reason for removal of your content and you may contest the decision by contacting us.

5.5 License Duration

The license for displaying your content in social features ends when you delete the content or your account.

5.6 Arena, Rankings and Moderation

An Arena record and its video are visible to signed-in users as soon as you submit them. Review happens afterwards: other users can report a record and we check reports. A rejected record is visible only to you.

• The video must show you performing the claimed result in full, unedited.
• How often a record can be updated depends on your tier: once every 30 days on the free tier, once every 24 hours on Forge.
• A confirmed fake record is a strike: the first is a warning, the second a 7-day Arena ban, the third a permanent Arena ban. During a ban your Arena results are removed from the rankings. You are notified in the app and may contest the decision by email.
• Rankings are built from all users' data and participation cannot be turned off. Detailed statistics can be hidden from your public profile in Settings.

6. Subscriptions & Payments

6.1 Free Tier

SyzUp offers a free tier with access to core features. Some features are limited on the free tier (for example the number of AI-generated plans, how often an Arena record can be updated, and daily Arena video views). The app contains no advertising.

6.2 Subscriptions (Forge and Trainer Pro)

• Forge (for athletes) and Trainer Pro (for trainers working with clients) are auto-renewing subscriptions, monthly or yearly, sold through Google Play. Prices, taxes and currency are shown by Google Play before you confirm. By purchasing, you also agree to Google Play's Terms.
• Subscriptions auto-renew unless cancelled at least 24 hours before the end of the current period. Manage or cancel in Google Play Store → Subscriptions. Deleting your SyzUp account does not cancel a subscription.
• If a free trial or introductory offer is shown in the store, its length is shown before you confirm; unless cancelled at least 24 hours before it ends, it becomes a paid subscription.
• Refunds are handled by Google Play in accordance with its refund policy. A refunded subscription loses its benefits immediately.
• We may change pricing with at least 30 days notice.

6.3 One-Off Purchases

SyzUp also sells one-off items through Google Play. There is no virtual currency.

• Cosmetics (hero cards, themes, timers) change only how the app looks for you. Each is bought once and stays on your account; some can instead be unlocked by reaching a level or earning a badge.
• Athena Shield is a consumable. One charge lets one missed day of your training plan count towards the weekly XP bonus. At most one charge can be used per week and up to 9 can be held. Charges can also be earned on the Syzyf map. A Shield never changes a workout, a record or an Arena position.
• Refunds are handled by Google Play. A refunded cosmetic is removed from your account; a refunded Shield has its charges deducted, which can leave a negative balance until it is made up.
• Items have no cash value, cannot be transferred or exchanged, and are lost when your account is deleted.

6.4 Referral Program

Referral codes are issued by us to partners. If you enter a valid code during sign-up or in Settings, you receive Forge free of charge for the period shown with the code (normally 30 days), without any subscription. A code can be redeemed once per account and once per device, cannot be your own, and each code has a limited number of uses. Partner commissions are governed by a separate agreement. Abuse of the program (fake accounts, self-referrals, automation) results in disqualification and potential account suspension or ban.

7. Intellectual Property

SyzUp and its content (code, design, UI, graphics, exercise database, translations, gamification system, mythology-themed naming) are owned by SyzUp's operator and protected by copyright and intellectual property laws. You may not copy, modify, distribute, or create derivative works without written permission.

7.1 Limited License

Subject to these Terms, we grant you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to download, install, and use SyzUp on your personal devices for personal, non-commercial purposes.

8. Limitation of Liability

Without limiting the foregoing, we are not liable for:

• Physical injuries or death sustained while performing any exercises tracked, suggested, recommended, or generated by SyzUp, including those from AI-generated workout plans.
• Health consequences of any kind resulting from following fitness content, calculations, estimates, or recommendations.
• Aggravation of pre-existing conditions resulting from use of the app.
• Injuries from improper exercise form or technique, even if exercises were suggested by the app.
• Data loss due to device failure, bugs, or service interruptions.
• Third-party content, products, or services linked within the app.
• User-generated content posted by other users.
• Service interruptions from maintenance, updates, third-party outages, or force majeure.
• Inaccuracy of AI-generated plans, calculations, or any computed values.
• Actions taken by you based on any information provided by the app.

Maximum liability: In no event shall our total aggregate liability exceed the greater of (a) the amount you paid us in the 12 months preceding the claim, or (b) €50 / $50 USD.

9. Disclaimer of Warranties

SyzUp is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, and accuracy.

We do not warrant that:

• The app will be uninterrupted, error-free, or secure.
• Workout plans will be safe, accurate, or suitable for you.
• AI-generated content will be free of errors.
• Calculations or estimates will be accurate for your individual physiology.
• The app will meet your specific fitness goals.
• Data will never be lost.

For EU/EEA consumers, this section does not affect statutory conformity rights under mandatory consumer protection law.

10. Indemnification

To the maximum extent permitted by applicable law, you agree to indemnify, defend, and hold harmless SyzUp and its operator from any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from or related to:

• Your use or misuse of the app.
• Your violation of these Terms.
• Your violation of any applicable law or third-party rights.
• Content you post through social features.
• Physical injury, illness, disability, or death arising from exercises you perform, regardless of whether those exercises were tracked, suggested, or generated by SyzUp.
• Any claims by third parties arising from your use of the app.

This indemnification obligation does not apply to the extent prohibited by the mandatory laws of your jurisdiction (including EU consumer protection law).

11. Governing Law & Dispute Resolution

11.1 Governing Law

These Terms are governed by the laws of the State of Wyoming, USA, without regard to conflict-of-law principles.

11.2 EU Consumers

If you are a consumer residing in the EU/EEA, you may bring proceedings in the courts of your country of residence. Mandatory consumer protection laws of your country apply regardless of the governing law chosen above. The European Commission's online dispute resolution platform closed on 20 July 2025; you can write to us at [email protected], and the alternative dispute resolution bodies in your own country remain available to you.

11.3 United States

If you are a US resident, you agree that any dispute not resolved informally within 60 days shall be resolved through binding individual arbitration under the rules of a recognized arbitration body, and not through class action. You waive any right to participate in class actions or class-wide arbitration, where such waiver is permitted by law. This arbitration provision is governed by the Federal Arbitration Act. Small claims court actions are exempt from this arbitration requirement.

11.4 Other Jurisdictions

For users outside the EU and US, disputes shall be resolved in the competent courts of Wyoming, USA, unless the mandatory laws of your jurisdiction require otherwise.

11.5 Informal Resolution First

Before initiating any formal dispute proceedings, you agree to contact us by email and attempt to resolve the dispute informally for at least 60 days.

12. Termination

You may stop using SyzUp at any time by deleting your account (Settings → Delete account, at the bottom of the screen) or at syzup.app/delete-account. Deletion is immediate and cannot be undone. Records required by law or for security (billing events, security logs, partner commission records and the deletion confirmation) are kept for the periods stated in the Privacy Policy. Uninstalling the app does not delete your account or cancel a subscription.

We may suspend or terminate your account for violating these Terms, with or without notice.

Additional suspension rights: We may also temporarily suspend access to the app or specific features to protect security, investigate suspected fraud or abuse, comply with legal obligations, prevent harm to users, or perform maintenance.

Upon termination, your right to use the app ceases immediately. Provisions that by their nature should survive termination (including Sections 2, 5.5, 8, 9, 10, and 11) survive termination.

13. Changes to These Terms

We may update these Terms. When we do, you will be asked to accept the new version in the app before continuing to use SyzUp, and the Terms show the date they were last updated. If you do not accept the new version, you may stop using SyzUp and delete your account.

14. General Provisions

Severability: If any provision is found unenforceable, it shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions remain in full effect.

Entire agreement: These Terms and our Privacy Policy constitute the entire agreement between you and SyzUp regarding your use of the app.

Waiver: Our failure to enforce any provision is not a waiver of that provision.

Assignment: We may assign these Terms in connection with a merger, acquisition, or sale of assets. You may not assign your rights or obligations under these Terms.

Force majeure: We are not liable for failures or delays caused by events beyond our reasonable control, including natural disasters, wars, cyberattacks, pandemics, power outages, or third-party service failures.

Backups: You are responsible for maintaining your own copies of content you upload. You may also export your account data through the in-app data export feature.

Beta features: Experimental or beta features may be incomplete, contain bugs, change without notice, or be discontinued at any time.

Export compliance: You agree not to use or export the app in violation of applicable export control or sanctions laws.

Electronic communications: You consent to receive communications from us electronically, including by email and in-app notifications.

App store terms: Apple and Google are not parties to these Terms, except as required by their respective platform rules. Your use of Google Play is additionally governed by Google's terms.

Language versions: These Terms are available in multiple languages. The English version prevails in the event of any discrepancy; other language versions are provided for convenience only.
